Is your consent banner well designed?
Having a banner does not necessarily mean it is appropriate. A presentation where “Accept all” is prominent and “Reject” is hidden can artificially push a person toward a less privacy-protective choice. Présence Marketing favours mechanisms with choices that are easy to understand, visible and changeable later.

Forms and consent
Every form is a collection point. A contact, quote, registration or download form should explain its purpose, request only useful information, provide access to the privacy policy and distinguish consent needed to answer an inquiry from optional marketing consent.

Your privacy policy
Your policy should be easy to find, complete and adapted to your reality. Depending on the context, it can address the organization’s identity, information collected, collection purposes and methods, cookies, vendors, transfers, retention, security, individual rights, consent withdrawal, privacy contact details and update date.
A policy copied from another website can be worse than an incomplete policy if it describes practices your organization does not use.

Why take privacy seriously?
Consequences can reach far beyond the website: trust, reputation, relationships with customers and partners, incident management, management time and organizational credibility. In Québec, certain violations can lead to fines ranging from $15,000 to the greater of $25 million or 4% of the previous fiscal year’s worldwide turnover. This amount is not the automatic penalty for a single banner error: seriousness, duration, information sensitivity and other factors may be considered.

Depending on the plan and needs, Présence Marketing may include standard consent technologies in its managed technical stack; Presence Premium includes them where relevant. Exact RH Law 25 and privacy support is not automatically included; it remains available separately with preferential pricing for eligible Présence clients.
